2. Right to Know the Role of BodyInc

You have the right to understand that BodyInc is not your treating healthcare provider.

BodyInc may provide:

  • technology services;

  • administrative support;

  • patient intake collection;

  • scheduling;

  • payment processing;

  • customer service;

  • communications;

  • provider coordination;

  • pharmacy coordination;

  • determine medical eligibility;

  • select your treatment;

  • determine your medication or dosage;

  • provide independent medical advice; or

  • override the clinical judgment of your treating healthcare professional.

Clinical decisions are made by the independent healthcare professional responsible for your care.

3. Right to Independent Clinical Decision-Making

Your treating healthcare professional is responsible for evaluating your individual circumstances and determining whether treatment is clinically appropriate.

You have the right to receive clinical decisions from the healthcare professional responsible for your consultation without BodyInc directing or overriding those decisions.

BodyInc personnel do not make clinical decisions on behalf of independent healthcare professionals.

4. Right to Communicate With Your Healthcare Provider

Questions concerning your medical condition, treatment, prescription, dosage, medication, contraindications, side effects, or other clinical matters should be directed to the independent healthcare professional responsible for your care.

BodyInc customer-support personnel may assist with administrative matters and may facilitate communications or relay information between you and the applicable healthcare professional.

Administrative assistance does not constitute medical advice.

5. Right to Your Medical Records

Your treating healthcare professional and/or applicable professional entity is responsible for maintaining the clinical record associated with your care, subject to applicable law.

BodyInc may also maintain information within its own technology systems relating to administrative services, intake, prescription history, communications, coordination, and other functions performed by BodyInc.

Because BodyInc is not the treating healthcare provider, a request for the complete clinical record should generally be directed to the healthcare professional or professional entity responsible for your care.

BodyInc will reasonably assist in identifying or directing you to the appropriate provider when appropriate.

Nothing in this section limits any right you may have to obtain records directly from your treating healthcare provider.

6. Right to Request Information From BodyInc

You may contact BodyInc to request access to information that BodyInc maintains about you, subject to applicable law and any applicable legal exceptions.

Depending on the type of information and applicable law, you may also request:

  • correction of inaccurate information;

  • deletion of information where legally available;

  • information concerning certain uses or disclosures; or

  • other rights provided by applicable privacy laws.

BodyInc may need to verify your identity before processing a request.

Certain requests may be subject to legal limitations, exemptions, retention requirements, or other applicable restrictions.

7. Health Information and Privacy Rights

BodyInc may receive, maintain, transmit, or otherwise process health information in connection with its technology and administrative functions.

Where BodyInc handles protected health information ("PHI") on behalf of a HIPAA covered entity or other regulated organization in a capacity subject to HIPAA, BodyInc will handle that information in accordance with applicable HIPAA requirements and its applicable contractual obligations.

Your treating healthcare provider may have separate HIPAA obligations and may provide you with a separate Notice of Privacy Practices.

You should review the privacy notice provided by your treating healthcare provider for information concerning the provider's use and disclosure of your PHI.

You may also have additional rights under state privacy or health-data laws.

8. Right to Seek Care Elsewhere

You may discontinue use of the BodyInc Platform and seek healthcare services from another qualified healthcare professional at any time, subject to any obligations or charges that have already been incurred.

BodyInc does not restrict your ability to seek care from another provider.

Discontinuing use of the Platform does not eliminate your right to request applicable records from your treating healthcare provider or information maintained by BodyInc, subject to applicable law.

9. Provider Choice and Provider Changes

Healthcare professionals available through the Platform are independent professionals.

Availability of a particular healthcare professional may change.

BodyInc does not guarantee that a specific healthcare professional will remain available through the Platform.

When legally and operationally appropriate, BodyInc may coordinate services with another appropriately licensed healthcare professional.

Any provider change does not authorize BodyInc to make or alter clinical decisions.

10. Right to Information Concerning Prescriptions

If an independent healthcare professional determines that a prescription is appropriate, the prescription decision belongs to that healthcare professional.

BodyInc may provide administrative assistance with prescription or order coordination.

The applicable pharmacy is responsible for dispensing, compounding, packaging, labeling, and fulfillment functions within the pharmacy's professional and legal responsibilities.

BodyInc does not alter a healthcare professional's prescription or make independent prescribing decisions.

Compounded medications are not the same as FDA-approved commercially manufactured drugs.

The independent healthcare professional is responsible for determining whether a medication is appropriate for you.

The applicable pharmacy is responsible for its dispensing and compounding responsibilities.

BodyInc may provide administrative and coordination services but does not independently determine whether a compounded medication is clinically appropriate.

12. Right to Privacy

BodyInc maintains a Privacy Policy explaining how information may be collected, used, maintained, and disclosed.

BodyInc does not sell personal information or health information to third parties.

Information may nevertheless be disclosed to independent healthcare professionals, healthcare service companies, pharmacies, laboratories, communications providers, healthcare technology providers, payment processors, and other service providers when reasonably necessary to provide or coordinate services, operate the Platform, comply with law, or for other purposes permitted by applicable law.

You may review the BodyInc Privacy Policy for additional information.

13. Marketing and Testimonial Consent

BodyInc will not use your name, photograph, likeness, testimonial, or similar personally identifiable content in marketing materials without the separate consent required by applicable law.

Where consent is requested for marketing or testimonial use, that consent will be separate from your agreement to use the Platform and will not be required as a condition of purchasing or receiving services

Where applicable, you may revoke testimonial or marketing consent in accordance with the terms of the applicable consent.

Revocation does not necessarily require BodyInc to remove materials that were lawfully created or published before revocation where removal is not legally required.

14. Right to Decline Marketing Communications

Marketing communications are separate from service and operational communications.

You may withdraw marketing consent at any time using the applicable unsubscribe or opt-out method.

You should promptly correct information that could affect:

  • your identity;

  • age;

  • location;

  • contact information;

  • medical history;

Providing accurate information supports appropriate administrative coordination and allows the independent healthcare professional to make clinical decisions using the information available to them.
